Class 3 Planning Exemptions
Under the Planning and Development Regulations, Ireland (S.I. No. 600/2001), residential structures constructed to the rear of houses are exempted from planning under explicit criteria.
The Primary Irish Exemption Criteria
Total Maximum Allowed Space
The total internal area of all combined structures built to the rear of the main house after 2001 must not exceed 25 square meters for simple builds, or up to 45 square meters with a certified extension layout outline matching the criteria.
Minimum Private Garden Reserve
The open space (garden) remaining to the rear of the main property must not be less than 25 square meters. This space must remain strictly private for residential outdoor use.
Max Height Restrictions
Pitched roofs must not exceed a maximum height of 4.0 meters. Standard contemporary flat-roof cabins must not exceed 3.0 meters of vertical clearance.
No Habitability Subletting
Exempted rooms cannot be utilized as a completely independent primary residence or leased out as an independent commercial rental apartment units without formal council notification permission.
